A RESOLUTION GRANTING A GROUP HOUSING PROJECT PURSUANT TO SECTION <br />40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS <br />~ENDED, SAID PROJECT BEING LOCATED ON THE SOUTH SIDE OF ELLIOTT <br />AVENUE BETWEEN FREDERICK AND DEEP CREEK BOULEVARDS AND DESIG/~ATED <br />AS GHP-84-5. <br /> <br /> WHEREAS, C. Raeford Eure has made application pursuant to <br />~40-55 of the Code of the City of Portsmouth, Virginia, 1973, <br />as amended, for the granting and approval of a Group Housihg <br />Project consisting of one hundred eight (108) condomini%um units <br />to be developed on the south side of Elliott Avenue between <br />Frederick Boulevard and Deep Creek Boulevards and designated <br />as GHP-84-5; and <br /> <br /> WHEREAS, the application has been determined by the Planning <br />Commission to have met the requirements of ~40-55 of the Code of <br />the City of Portsmouth, Virginia, 1973, as amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application <br />and site plan submitted therewith, and has recommended a conditional <br />approval of said application; and <br /> <br /> W~REAS, the developer has been informed that approval of <br />a Group Housing Project pursuant to ~40-55 grants only an exemp- <br />tion from certain requirements for residences as stated in said <br />section, and does not constitute a waiver of any other requirement <br />embodied in the subdivision ordinance, zoning ordinance, the <br />Code of the City of Portsmouth, Virginia, or any other applicable <br />local, state or federal laws or regulations; and <br /> <br /> WHEREAS, the developer is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinance, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia that the certain Group Housing Project <br />designated as GBP-84-5, and more specifically shown on plans <br />prepared by Hoggard/Eure Associates, dated March 19, 1984, and <br />filed with the appropriate officials of the City of Portsmouth, <br />Virginia, and made a part hereof, is hereby granted approval <br />subject to the following terms and conditions: <br /> <br /> 1. Standard site improvement plans be submitted to the <br />City Engineer for review and approval. Such plans must include <br />dumpster locations as approved by the Department of Public Works. <br /> <br />including <br />installed <br /> <br />No occupancy permits shall be issued until landscaping, <br />proposed berm, as shown on submitted plans, is properly <br />and approved by the City Engineer. <br /> <br /> <br />
