34 <br /> <br />A RESOLUTION GRANTING A GROUP HOUSING PROJECT PURSUANT TO SECTION <br />40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS <br />AMENDED, SAID PROJECT BEING LOCATED AT ELLIOTT AVENUE AND BEACON <br />ROAD AND DESIGNATED GHP-84-4. <br /> <br /> WHEREAS, Carlton E. McCuiston has made application pursuant <br />to ~40-55 of the Code of the City of Portsmouth, Virginia, 1973, <br />as amended, for the granting and approval of a Group Housing <br />Pro~ect consisting of eighteen. (18) apartment units on a vacant <br />lot located at the southeast corner of Elliott Avenue and'Beacon <br />Road; and <br /> <br /> WHEREAS, the application has been determined by the Planning <br />Commission to have met the requirements of ~40-55 of the Code of <br />the City of Portsmouth, Virginia, 1973, as amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application <br />and site plan submitted therewith, and has recommended a conditional <br />approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of <br /> a Group Housing Project pursuant to ~40-55 grants only an exemption <br /> from certain requirements for residences as stated in said section, <br /> and does not constitute a waiver of any other requirement embodied <br /> in the subdivision ordinance, zoning ordinance, the Code of the <br /> City of Portsmouth, Virginia, or any other applicable local, state <br /> or federal laws or regulations; and <br /> <br /> WHEREAS, the developer is aware that building permits or any <br />other required permit will be issued only upon compliance with <br />the ordinance, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia that %he certain Group Housing Project <br />designated as GHP-83-6, more specifically described in correspondence <br />from tke applicant received by the Director of Planning on February <br />15, 1984 as shown on plans prepared by C. Raeford Eure and Dan E. <br />Griffin, dated January 1984, and filed with the appropriate officials <br />of the City of Portsmouth, Virginia, such correspondence and plans <br />being made a part hereof, is hereby granted approval subject to <br />the following terms and conditions: <br /> <br />Planning <br />building <br /> <br />A detailed landscape plan must be submitted to the <br />Office for review and approval prior to issuance of <br />permits. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held April 24, 1984. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
