A RESOLUTION GRANTING A USE PERMIT TO MILTON L. HILL, GLADYS B. HILL, AND BARBARA LEE TO OPERATE A CHILD CARE CENTER'AT 1500 SUMMITT'AVENUE. 124 WHEREAS, Milton L. Hill, Gladys B. Hill, and Barbara Lee, have made application pursuant to ~40-78 (b) of the Code of the City of Portsmouth, Virginia, I973, for the granting of a use permit to operate a child care center; and WHEREAS, the applicant and the Planning Director have done all things.required to be done in connection with said application; and ~ WHEREAS, the Planning Conum3~ssionhas recommended the granting of a use permit for the operation of a child care center as defined in ~40-31 of said Code. NOW, TR~REFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter- described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the pro- posed use; (b) will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; and (c) will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Milton L. Hill, Gladys B. Hill, and Barbara Lee, are hereby granted a use permit pursuant to ~40-78 (b) of the City Code to operate a child care center at 1500 EunLmitt Avenue, such property being more particularly described as follows: UP-8'4~'I6 BEGINNING at the northwest corner of Beech Street .and Summitt Avenue; thence west along the northern right-of-way of Summitt Avenue 75'; thence north 108'; thence east 75' to the west ~ight-of- way of Beech Street; thence south along said right- of-way 108' to Summitt Avenue, the Point of Origin.
