AN ORDINANCE CLOSING A PORTION OF SOUTHERN AVENUE. <br /> <br /> WHEREAS, Portsmouth Port and Industrial Commission has <br />made application to vacate, close and discontinue the herein- <br />after-described portion of Southern Avenue; and <br /> <br /> WHEREAS, by resolution of this Council adopted April <br />24, 1984, viewers were appointed pursuant to ~15.1-364, <br />Code of Virginia, 1950, as amended, to view Lhe hereinafter- <br />described portion of said street, and to report in writing <br />whether in their opinion any, and if any, what inconvenience <br />would result frcm discontinuing said street; and <br /> <br /> WHEREAS, said viewers have reported in writing that <br />in their opinion no inconvenience would result from the closing <br />and discontinuing of said street. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the <br />City of Portsmouth, Virginia that the hereinafter-described <br />portion of Southern Avenue be closed and vacated as a public <br />street. <br /> <br />SOUTHERN AVENUE <br /> <br /> Ail that portion of Southern Avenue as <br />shown on the plat of "Pinners Point Waterfront <br />Company", which is described as beginning at the <br />west side of Hill Avenue and running a width of <br />60' for a distance of 100' wes% to the previous- <br />ly closed portion of Southern Avenue. <br /> <br /> BE IT FURTHER ORDAINED that the City of Portsmouth re- <br />serves unto itself a perpetual easement, privilege and right- <br />of-way to install, maintain, operate and replace sanitary <br />sewers and lines and electric power lines, together with the <br />right of ingress and egress for the purpose of maintaining, <br />operating, and replacing a sanitary sewer suction well, over, <br />under and across the hereinabove-described portion of Southern <br />Avenue. <br /> <br /> This ordinance shall become effective from the date of <br />its adoption. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held May 8, 1984. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
