AN ORDINA~NCE TO AFiEND ARTICLE 2 OF CHAPTER 21 OF THE CODE OF <br />THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS APLENDED, BY ADDING <br />THERETO ~21-18.3 PERTAINING TO PROPRIETARY MRDICINES AND <br />IMITATION CONTROLLED SUBSTANCES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia, that Article 2 of Chapter 21 of the Code of the City <br />of Portsmouth, Virginia, 1973, as amended, be amended by add- <br />ing thereto S21-18.3, such section to read as follows: <br /> <br />Section 21-18.3. <br /> <br />Pharmacist required for certain businesses <br />selling proprietary medicines and imitation <br />controlled substances. <br /> <br /> The owner or proprietor of any establishment which has <br />gross sales of proprietary medicines, non-prescription drugs, <br />over-the-counter drugs, and imitation controlled substances <br />as defined in §21-18.1 exceeding seventy-five percent (75%) <br />of total gross sales shall employ a registered pharmacist on <br />the premises during business hours. <br /> <br /> Any person violating the provisions of this section shall <br />be guilty of a Class 1 Misdemeanor. <br /> <br /> 2.
