Section 31-65. Ordinary Disability Retirement Allowance. <br /> <br /> (a)' Upon retirement as provided in Section 31-64, <br />on or after July i, 1977, a me/nber shall receive an ann~al <br />retirement allowance, payable~at least monthly to him dur- <br />ing his life time, and continued disability in an amount <br />determined as follows: <br /> <br /> el) With respect to any allowance falling due <br />in a month before the member's normal retirement date and <br />before any social security allowance payment falling due <br />that is based on the member's primary social securiry <br />benefit, or before entitlement to total and permanent dis- <br />ability benefits under the Social Security Act, two percent <br />(2%) of his average final compensation multiplied by the <br />number of years of his "disability credited service" as <br />herein defined. <br /> <br /> (2) With respect to any allowance payment falling <br />due after the member's normal retirement date, or in a month <br />before ~he member's normal retirement date and after any <br />social security allowance payment falling due that is based <br />on the member's primary social security benefit, or after <br />entitlement to total and permanent disability benefits under <br />the Social Security Act, the larger of; (i) one and fifteen <br />one hundredths percent (1.15%) of his average final compen- <br />sation multiplied by the number of years of his "disability <br />credited service"; or (ii~ the excess of (X) two percent <br />(2%) of his average final compensation multiplied by the <br />number of years of his "disability credited service" over <br />Cy~ two percent ~%) of the annual amount of the primary <br />social security benefit at his normal retirement date to <br />which he is or would have been entitled at his normal retire- <br />ment date or two percent (2%) of the initial amount of any <br />social security allowance payment that is based on the member's <br />primary social security benefit and falling due before the <br />member's normal retirement date, or two percent (2%) of the <br />amount of primary total and permanent disability benefit under <br />the Social Security Act to which the member first became en- <br />titled, multiplied by the number of years of his "disability <br />credited service" not in excess of twenty-five (25) such years. <br /> <br />Section 31-148. Service Retirement. <br /> <br /> (bi The provisions of subsection (a) of~th~s section to <br />the contrary notwithstanding, any member remaining in service <br />after his normal retiremen~ date who attains seventy (70) years <br />of age shall be retired forthwith. In no event shall any member's <br />creditable service or creditable compensation include any period <br />of service or any compensation after attaiD~ent of age sixty-five <br />(65!. <br /> <br /> <br />
