AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTIONS 31-62 (b); 31-63 (a) <br />(1) (2); 31-65 (a) (1) (2); 31-148 (b); AND 31-155 (b); PER- <br />TAINING TO RETIREMENT ALLOWANCE. <br /> <br /> BE IT ORDAINED by the CounciI of the City of Portsmouth, <br />Virginia that Sections 31-62 (b); 31-63 (a) (1) (2); 31-65 <br />(a) (1) (2); 31-148 (b); and 31-155 (b) of the Code of the <br />City of Portsmouth, Virginia be amended to read as follows: <br /> <br />Section 31-62. Service Retirement. <br /> <br /> (b) The provisions of subsection (a) of this section <br />to the contrary notwithstanding, any meraber attaining age <br />seventy (70) shall be retired forthwith. In no event shall <br />a member's creditable service or creditable compensation <br />include any period of service or any compensation after at- <br />tainment of his normal retirement date. <br /> <br />Section 31-63. Service Retirement Allowance. <br /> <br /> (a) Upon the retirement, as provided in subsection (a) <br />or subsection (b) of Section 31-62, on or after July 1, 1977, <br />of amember who either has attained his normal retirement <br />date or has both attained age sixty (60) and completed twenty- <br />five (25) years of creditable service, the member shall receive <br />an annual retirement allowance, payable at least monthly to <br />him during his life time, the amount of which shall be deter- <br />mined as follows: <br /> <br /> (1) With respect to any allowance payment falling <br />due in a month before the member's normal retirement date, <br />or in a month before the member's normal retirement date and <br />before any social security payment falling due that is based <br />on the member's primary social security benefit, two percent <br />(2%) of his average final compensation multiplied by the <br />number of years of his creditable service. <br /> <br /> (2) With respect to any allowance payment falling <br />due after the member's normal retirement dater or in a month <br />before the member's normal retirement date and after any social <br />security allowance payment falling due that is based on the <br />member's primary social security benefit, the larger of (i) <br />one and fifteen one hundredths percent (1.15%) of his average <br />final compensation multiplied by the number of years of his <br />creditable service; or (ii) the ~xcess of (x) two percent (2%) <br />of his average final compensation multiplied by the number of <br />years of his creditable service over (y) two percent (2%) of <br />the annual amount of the primary social security benefit com- <br />mencing at his normal retirement date to which he is or would <br />have been entitled at his normal retirement date, or two per- <br />cent (2%) of the initial amount of any social security benefit <br />and falling due before the member's normal retirement date, <br />multiplied by the nu/uber of years of his creditable service, <br />not in excess of twenty-five (25) such years. <br /> <br /> <br />
