AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING SECTIONS 31-62 (b); 31-63 (a) (1) (2); 31-65 (a) (1) (2); 31-148 (b); AND 31-155 (b); PER- TAINING TO RETIREMENT ALLOWANCE. BE IT ORDAINED by the CounciI of the City of Portsmouth, Virginia that Sections 31-62 (b); 31-63 (a) (1) (2); 31-65 (a) (1) (2); 31-148 (b); and 31-155 (b) of the Code of the City of Portsmouth, Virginia be amended to read as follows: Section 31-62. Service Retirement. (b) The provisions of subsection (a) of this section to the contrary notwithstanding, any meraber attaining age seventy (70) shall be retired forthwith. In no event shall a member's creditable service or creditable compensation include any period of service or any compensation after at- tainment of his normal retirement date. Section 31-63. Service Retirement Allowance. (a) Upon the retirement, as provided in subsection (a) or subsection (b) of Section 31-62, on or after July 1, 1977, of amember who either has attained his normal retirement date or has both attained age sixty (60) and completed twenty- five (25) years of creditable service, the member shall receive an annual retirement allowance, payable at least monthly to him during his life time, the amount of which shall be deter- mined as follows: (1) With respect to any allowance payment falling due in a month before the member's normal retirement date, or in a month before the member's normal retirement date and before any social security payment falling due that is based on the member's primary social security benefit, two percent (2%) of his average final compensation multiplied by the number of years of his creditable service. (2) With respect to any allowance payment falling due after the member's normal retirement dater or in a month before the member's normal retirement date and after any social security allowance payment falling due that is based on the member's primary social security benefit, the larger of (i) one and fifteen one hundredths percent (1.15%) of his average final compensation multiplied by the number of years of his creditable service; or (ii) the ~xcess of (x) two percent (2%) of his average final compensation multiplied by the number of years of his creditable service over (y) two percent (2%) of the annual amount of the primary social security benefit com- mencing at his normal retirement date to which he is or would have been entitled at his normal retirement date, or two per- cent (2%) of the initial amount of any social security benefit and falling due before the member's normal retirement date, multiplied by the nu/uber of years of his creditable service, not in excess of twenty-five (25) such years.
