AN ORDINANCE TO AMEND THE CODE OF T~E CITY OF PORTSMOUTH, VIRGINIA, 1973, BP ~24ENDING SECTION 21-143 THEREOF, PERTAIN- ING TO "GOING OUT OF BUSINESS" SALES. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: t. That Section 21-143 of the Code of the City of Portsmouth, Virginia, 1973, be amended and reordained to read as follows: Section 21-143. "Going out of business" sales; permits required. {a} It shall be unlawful ~or any person to advertise or conduct a sale for the purpose of discontinuing a retail business, or to modify the word "sale" in any advertisement with the words "going out of business" or any other words which tend %o insinuate that the retail business is to be discontinued and %he merchandise liquidated, unless such person first obtains a special sale permit to conduct such sale from the Commissioner of the Revenue. ~b~ At the time of making application for such a special sale permit, the applicant shall submit for inspection to the Commissioner of the Revenue the advertisement for said sale and the Commissioner of the Revenue shall inspect the conducting of such sale to insure that it is being advertised and conducted in conformity with the required special sale permit. [c) Ali applications for special sale permits shall be accompanied by an inventory, including the kind and quantity of all goods which are to be offered for sale during the sale, and only the goods specified in the inven- tory list may be advertised at a reduced price or sold at a reduced price during the sale period. Goods not included on the inventory of special sale goods shall not be commingled with or added to the special sale goods. [d~ Each special sale permit shall be valid for a period of no longer than sixty (60) days, and any extension of that time shall constitute a new special sale and shall require an additional permit and inventory and inspection of advert±sement~as provided for herein. -A maximu~ of two (2) additional permits beyond the initial sixty (60) day permit shall be granted solely for the purpose of liquidating only those goods contained in the initial inventory list and which remain unsold.
