AN ORDINANCE TO ~END SECTION 20-52 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA, 1973, PERTAINING TO RETAIL SALES, <br />AND TO ADD TO CHAPTER 20 SECTIONS 20-52.1, 20-52.2 AND <br />20-52.3 PERTAINING TO PEDDLERS AND ITINERANT MERCHANTS. <br /> <br /> BE IT ORDAINED by the Council of the City of Ports- <br />mouth, Virginia: <br /> <br /> 1. That Section 20-52 of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended and reordained as <br />Sections 20-52, 20-52.1, 20-52.2 and 20-52.3 as follows: <br /> <br />Section 20-52. Retail Sales. <br /> <br /> Any person engaged in retail sales shall pay a business <br />license tax of fifty dollars ~$50.00) on the first $5,000.00 <br />of gross receipts and ~wenty-eight cents ($0.28) per $100.00 <br />on each additional $100.00 of gross receipts. Retail sales <br />shall be defined to include, but not be limited to, the sale <br />of goods, wares and merchandise for any purpose other than <br />resale, but not including sales and wholesale to institutional, <br />commercial and industrial users. Furthermore, retail sales <br />shall not include sales by peddlers, door-to-door salesmen, <br />or sales by itinerant merchants. <br /> <br />Section 20-52.1. Peddlers and Door-To-Door Salesmen. <br /> <br /> (a) Every person peddling goods, wares, merchandise or <br />products of any description or who sells any items door-to- <br />door, shall pay a business license tax of five hundred <br />dollars ($500.00) per year. <br /> <br /> (b) A peddler is defined as any person who carries <br />from place to place any goods, wares, food or merchandise <br />purchased for resale and offers to sell, or actually sells <br />and delivers, the same at retail. The definition of "peddler" <br />as prow[ded in Section 58-340 of the Code of Virginia, 1950, <br />as amended, is further adopted herein and incorporated by <br />reference. <br /> <br /> (c) No peddler shall be per--mitred, while doing business <br />as a peddler to keep his vehicle in one location on the <br />streets for a longer period of time than ten (10) minutes, <br />and shall not make sales in front of or near a place of <br />business where business similar to that conducted by the <br />peddler is transacted. Any person violatLng the provisions <br />of this subsection shall be guilty of a Class 4 Misdemeanor <br />for each such offense. <br /> <br /> <br />
