AN ORDINANCE CLOSING A PORTION OF CEMETERY LANE. WHEREAS, Portsmouth Redevelopment and Housing ~uthority has made application to vacate, close, and discontinue the hereinafter-described portion of Cemetery Lane; and WHEREAS, by a resolution adopted by this Council for September 25, 1984, viewers were appointed pursuant to ~15.1-364, Code of Virginia, 1950, as amended, to view the hereinafter- described portion of said street, and to report in writing whether in their opinion any, and if any, what inconvenience would result from discontinuing said street; and WHEREAS, said viewers have reported in writing that in their opinion no inconvenience would result from the closing of said street. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that the hereinafter-~escribed portion of Cemetery Lane be closed and vacated as a public street. CEMETERY LANE Ail that certain piece or parcel of land, lying and being in the City of Portsmouth, Vir- ginia, beginning at a point on the south side of Cemetery Lane 176.63' north 86e46'48" east from the southeast intersection of Cemetery Lane and Fort Lane; thence north 03°13'12" west 31.01'; thence north 86043'23'' east 8'; thence south 3~ 16'23" east 1.01'; thence north 86~46'48'' east 115.45' to the west side of Effingh.am Street; thence south 03032'49'' easu 30'; thence south 86~ 46'48" west 123.62' to the Point of Beginning. (S-84-13} The City of Portsmouth hereby reserves unto itself a per- pe. tual easement and right-of-way for the purpose of installing, operating, and maintaining public utility service on, under and across the hereinabove-described street.
