Sectio~ 31-265. Ordinary disability retirement allowance. <br /> <br /> (a) Upon retirement as provided in Section 31-264, on or <br />after July 1, 1977, a member shall receive an annual retirement <br />allowance, payable at least monthly to hi~ during his life <br />time, and continued disability in an amount determined as <br />follows: <br /> <br /> (1) With respect to any allowance falling due in a <br />month before the member's normal retirement date and before <br />any social security allowance payment falling due that is <br />based on the member's primary social security benefit, or <br />before entitlement to total and permanent disability bene- <br />fits under the Social Security Act, two (2) per cent of his <br />average final compensation multiplied by the number of <br />years of his "disability credited service" as herein defined. <br /> <br /> (2) With respect to any allowance payment falling due <br />after the menlber's normal retirement date, er in a month be- <br />fore the member's normal retirement date and after any <br />social security allowance payment falling due that is based <br />on the member's primary social security benefit, or after <br />entitlement to total and permanent disability benefits under <br />the Social Security Act, the larger of: (i) one and fifteen one <br />hundredths (1.15) per cent of his average final compensa- <br />tion multiplied by the number of years of his "disability <br />credited service"; or (ii) the excess of (x) two (2) per cent of <br />his average final compensation multiplied by ~he number <br />of years of his "disability credited service" over Cy) two (2) <br />per cent of the annual amount of the primary social secu- <br />rity benefit at his normal retirement date to which he is or <br />would have been entitled at-his normal retirement date or <br />two (2) per cent of %he initial amount Of any social security <br />altowan~ce payment ghat is based on the member's primary social <br />security benefit and falling due before ~he member's normal <br />retirement date, or two (2) per cent of the amount of primary <br />total and permanent disability benefit under the Social <br />Security Act to which a member first became entitled, multiplied <br />by the number of years of his "disability credited service", <br />not in excess of twen~ty-five (25) such years. <br /> <br /> (b~ Per the purposes of this section, the <br />credited service" for any men,bet shall be taken <br />smallest of: <br /> <br />term "disability <br />to mea~ the <br /> <br />Twice the member's actual period of creditable service; <br /> <br /> (2)i The member's period of creditable service plus ten <br />(t0) years; <br /> <br />21 <br /> <br /> <br />
