(d) 'tflafter.termina%ion .of service .and~p~ior t~ retirement <br />as provided in subsect±~n ~c) of Section 31-262 subsections <br />or ~b) of this section are a~m~nded, the member's allowance cal- <br />culation shall be based on the amended subsections in effect <br />as of the .date of retirement. <br /> <br /> (e) The foregoing provisions to the contrary notwith- <br />standing, if a member's retirement allowance is payable under <br />one of the options of Section 31-274 the amount and duration <br />thereof shall be determined in accordance w~ith the provisions <br />of the applicable option. <br /> <br /> (f) The foregoing provisions to the contrary notwith- <br />standing, any person whose membership began on or after his <br />fifty-fifth (55th) birthday and after July 1, 1977, shall not <br />be eligible for or receive a retirement allowance as provided <br />for herein unless the member be in service at his normal <br />retirement date. <br /> <br />Section 31-264. ©rdinarydisabitity retirement. <br /> <br /> Any member in service who has five (5) or more years of <br />creditable service may, at any time on or after July 1, 1973, <br />and before his normal retirement date, retire on account of <br />disability not compensable under the Virginia Workmen's Com- <br />pensation Act upon written notification to the board made <br />by the member .or his employer, setting forth at which time <br />the retirement is to become effective; provided, that such <br />effective date shall be after the last day of service but shall <br />not be wore than ninety (90) days prior to %he date of such <br />notification; a~d provided further, the examiner, after a <br />medical examination ~f such member, shall certify: <br /> <br /> (1) That such member is, and has been continuously since <br />such effective date, if prior to the filing of such notice, <br />mentally or physically incapacitated for %~e further per- <br />formance of duty. <br /> <br />(2) That such incapacity is likely to be permanent. <br /> <br />(3~ That .such member should be retired. <br /> <br /> (4) That such member, at the time of his employment by <br />the City of Ports~onth, was not eliqible for or receivinq <br />retirement allowance or pension by ~eason of disability ~rom <br />any other employer. <br /> <br />20 <br /> <br /> <br />
