AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />1973, BY AMENDING SECTION 31-1, 31-2, 31-3, 31-13, 31-14, AND <br />31-22 OF ARTICLE t OF CHAPTER 31 THEREOF, PERTAINING TO THE <br />PORTS~]OUTH EMPLOYEE SUPPLEMENTAL RETIREMENT SYSTEM; AND BY <br />ADDING ARTICLE tV TO CHAPTER 31 THEREOF CONSISTING OF SECTIONS <br />31-201 THROUGH 31-290 PERTAINING TO THE PORTSMOUTH SUPPLE~ENTAL <br />RETIREMENT SYSTEM. <br /> <br /> BE IT OPJDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Sections 31-1, 31-2, 31-3, 31-13, 31-14 and 31-22 <br />of Article I of Chapter 31 of the Code of the City of Portsmouth, <br />Virginia, 1973, be amended to read as follows: <br /> <br />ARTICLE I. Portsmouth Employees <br /> Supplemental Retirement System. <br /> <br />Section 31-1. Definitions. <br /> <br /> That the hereinafter stated definitions in S3!-1 be amended <br />to read as follows: <br /> <br /> BOARD. The word "Board" shall be taken to mean the Board <br />of Trustees of the Portsmouth Employees Supplemental Retirement <br />System, as provided for in ~31-13 and 31-23. <br /> <br /> EMPLOYEE. The word "employee" shall be taken to mean any <br />~erson regularly employed in the service of the City on a full <br />time permanent basis and whose compensation is wholly paid by <br />the City, and persons holding offices in the City required by <br />the Constitution of this State and their depnties, assistants, <br />and employees employed on a full time permanent basis and whose <br />compensation is paid partly by the City and partly by ~he State; <br />but shall not include any person who is eligible for membership <br />in the Virgmnza Supplemental Retirement System, the Portsmouth <br />Fire and Police Retirement System, or who has selected membership <br />in the Portsmouth Supplemental Retirement System, or who enters <br />into an agreement with the City for inclusion in a deferred com- <br />pensation retirement plan which agre. ement specifically prohibits <br />inclusion in any other retirement systems established by the <br />City. An employee shall also be takem to mean any person em- <br />ployed under a grant program who has been regularly employed <br />zn the service of the City on a full time basis for a period <br />such that he will have become vested under the conditions as <br />stated in ~3t-62, and whereby such grant program has participated <br />in making the necessary contributions to the system for the full <br />period of the employee's service to be credited. In the case of <br />doubt, the Board shall decide who is an employee within the mean- <br />ing of this Article. <br /> <br /> <br />
