However, upon application, the City Planning Commission may, <br />at a regular monthly meeting, consider recommending a special <br />exception. The Commission shall take into account the relation- <br />ship of such a plot to other spaces and structures located in, <br />or proposed for this zoning district and ariving at its recom- <br />mendation and may cite comprehensive plan elements relative <br />thereto. The Commission shall forward to the City Council a <br />written report setting forth the extent to which restrictions <br />will be altered by special exception and justification therefor. <br />Upon considering such Planning Commission recommendation, the <br />City Council may, at a regularly scheduled meeting, grant a <br />special exception, the terms of which shall be specified and <br />performance guaranteed within a specific time. <br /> <br /> The Downtown D-1 Design Advisory Committee shall review and <br />approve design and landscaping of newly constructed parking lots. <br /> <br /> (v) Off-street loading: Space for this function shall <br />be provided as specified in Section 40-49. <br /> <br /> (vi) Minimum required floor area for a dwelling unit <br />exclusive of garages and patios: Six-Hundred (600) square feet. <br /> <br /> 8. That Section 40-122 be amended by adding subparagraph <br />(c) to read as follows: <br /> <br />Section 40-122. Certificate of Intent. <br /> <br /> (c) The certificate of intent shall be valid for a one (1) <br />year period from the date of issuance. <br /> <br /> 9. That Section 40-123 (a) and (c) be amended to read <br />as follows: <br /> <br />Section 40-123. Certificate of Compliance. <br /> <br /> (a) Before any modification, alterations, reconstruction, <br />construction, repair, maintenance activity, includinc painting <br />of an outer wall or part of a building or structure which are <br />subject to public view from a public street, public way or <br />other public place, occurs in the Downtown D-1 District, the <br />plans therefor shall be reviewed by the design committee. <br />Whenever any person shall apply for a building permit in such <br />area, a copy of the plans shall be filed with the committee <br />for review. <br /> <br /> (c) Nothing in this Chapter shall be construed to prevent <br />the owner of such building, structure or property in the <br />Downtown D-1 District from performing any maintenance alteration <br />or painting to the external architectural features of such <br />building, structure or property which does not involve a <br />change in design, material, color or the outward appearance <br />thereof and which maintenance, painting or alteration is of <br /> <br /> <br />
