AN ORDINANCE TO AMEND ARTICLE III OF CHAPTER 38 OF THE CODE OF THE CITY OF PORTSMOUTH, 1973, BY ADDI'NG THERETO DIVISION 3, 4 AND 5, PERTAINING TO WASTEWATER SEWERS, INDUSTRIAL DISCHARGE AND PRETREATMENT. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. ~hat the Code of the City of Portsmouth, Virginia, 1973, be amended by amending Article III of Chapter 38, and by adding thereto Division'3, 4 and 5 to read as follows: ARTICLE III. SESFERS AND SEWAGE DISPOSAL DIVISION 3. CONDITIONS OF USE OF THE CITY'S WASTEWATER S~ERS Section 38-100. General Provisions. 1.1. Purpose and Policy. This Article sets forth uniform requirements for direct and indirect contributors into the wastewater collection and treatment system for the City of Portsmouth and enables the City to comply with all applicable State and Federal laws required by the Clean Water Act of 1977 and the General Pre- treatment Regulations (40 CRF, Part 403). The objectives of this Article are: (a) To prevent the introduction of pollutants into the municipality wastewater system which will interfere with the operation of the system or contaminate the resulting sludge; (b) To prevent the introduction of pollutants into the municipal wastewater system which will pass through the system, inadequately treated, into receiving waters or the atmosphere or otherwise be incompatible with the system; (c) To improve the opportunity to recycle and reclaim wastewaters and sludges from the system; and ~d) To provide for equitable distribution of the cost of the municipal wastewater system. This Article provides for the regulation of direct and indirect contributors to the municipal wastewaber system through the issuance of permits to certain non-domeStic users and through enforcement of general requirements for the other users, authorizes monitoring and enforcement activities, requires users reporting, assumes that existing customer's capacity will not be preempted, and provides for the setting
