AN ORDINANCE TO AMEND ARTICLE III OF CHAPTER 38 OF THE CODE <br />OF THE CITY OF PORTSMOUTH, 1973, BY ADDI'NG THERETO DIVISION <br />3, 4 AND 5, PERTAINING TO WASTEWATER SEWERS, INDUSTRIAL <br />DISCHARGE AND PRETREATMENT. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. ~hat the Code of the City of Portsmouth, Virginia, <br />1973, be amended by amending Article III of Chapter 38, and <br />by adding thereto Division'3, 4 and 5 to read as follows: <br /> <br />ARTICLE III. SESFERS AND SEWAGE DISPOSAL <br /> <br />DIVISION 3. CONDITIONS OF USE OF THE <br /> CITY'S WASTEWATER S~ERS <br /> <br />Section 38-100. General Provisions. <br />1.1. Purpose and Policy. <br /> <br /> This Article sets forth uniform requirements for direct <br />and indirect contributors into the wastewater collection <br />and treatment system for the City of Portsmouth and enables <br />the City to comply with all applicable State and Federal laws <br />required by the Clean Water Act of 1977 and the General Pre- <br />treatment Regulations (40 CRF, Part 403). <br /> <br />The objectives of this Article are: <br /> <br /> (a) To prevent the introduction of pollutants into <br />the municipality wastewater system which will interfere <br />with the operation of the system or contaminate the resulting <br />sludge; <br /> <br /> (b) To prevent the introduction of pollutants into the <br />municipal wastewater system which will pass through the system, <br />inadequately treated, into receiving waters or the atmosphere <br />or otherwise be incompatible with the system; <br /> <br /> (c) To improve the opportunity to recycle and reclaim <br />wastewaters and sludges from the system; and <br /> <br /> ~d) To provide for equitable distribution of the cost of <br />the municipal wastewater system. <br /> <br /> This Article provides for the regulation of direct and <br />indirect contributors to the municipal wastewaber system <br />through the issuance of permits to certain non-domeStic users <br />and through enforcement of general requirements for the other <br />users, authorizes monitoring and enforcement activities, <br />requires users reporting, assumes that existing customer's <br />capacity will not be preempted, and provides for the setting <br /> <br /> <br />
