{5) Noncustodial employees of'the State Department <br />of CorreCtions designated to carry weapons by the Secretary of <br />Public Safety or the Director of the State Department of <br />Corrections pursuant'to ~53-39 of the 'Code of Virginia, 1950, <br />as amended. <br /> <br /> (d) Any resident of the City may apply In writing to t~ <br />Circuit Court fdr~the City of Portsmouthfor a one-year perml~ <br />to carry a specific type of concealed weapon. The Court, after <br />.consulting the law-enforcement authorities of the City and receiving <br />a report from the Central Criminal Records Exchange, shall issue <br />such permit if it finds that the applicant is of good character, <br />has demonstrated a need to carry such concealed weapon, is <br />physically and me,tally competent to carry sUch weapon and is'not <br />prohibited by l~w from receiving, possessing, or transporting <br />such weapon. <br /> <br /> The Court shall find that the applicant has demonstrated <br /> a need to carry a concealed weapon in the following circumstances: <br /> [1) The applicant regularly transports substantial sums <br /> of money or other property of substantial value from a place of <br /> business to his home or a b~nk or other secure depository. <br /> <br /> (2) The Court is convinced that because of bona fide <br /> threats to the body or life of the applicant or to the body <br /> or life of a member of the applicant'S immediate 'family, or <br /> because of other body or life-threatening circumstances peculiar <br /> to the applicant, there is probable cause to believe such permit <br /> is reasonable necessary to promote the self-protection of the <br /> applicant. <br /> <br /> In all ot~er cases the Court shall have discretion to <br /> determine whether need has been established. No fee shall be <br /> charged for the 'issuance of such permit to a person who has <br /> retired from service as a law-enforcement officer with the <br /> .Department of State Police, or with a sh~eriff or police depart- <br /> ment, bureau or force of any political subdivision of the <br /> C~mmonwealth of Virginia, after completing twenty-five years <br /> service or after reaching age fifty-five. The order issuing <br /> such permit shall be entered in the law order book of the Court. <br /> ~el tf any person carry about his person, hidden from <br /> common observation, any knife, hood, ice pick or other sharp <br /> instrument which has a blade or point ~ore than two and three- <br /> fourths (2-3/4) inches measured along the outside perimeter <br /> from base to tip of blade or point and which~is capable of <br /> inflicting upon a person a stab-or cut wound, he shall be <br /> guilty, of a Class' 1 misdemeanor. <br /> <br /> <br />
