AN ORDINANCE CLOSING A PORTION OF ELLIOTT AVENUE. <br /> <br /> WHEREAS, the City of Portsmouth, Virginia, has made <br />application to vacate, close and discontinue the <br />hereinafter-described portion of Elliott Avenue; and <br /> <br /> WHEREAS, by resolution of this Council adopted October <br />14, 1986, viewers were appointed pursuant to Section 15.1-364, <br />Code of Virginia, 1950, as amended, to view the <br />hereinafter-described portion of said street and to report in <br />writing whether in their opinion any, and if any what, <br />inconvenience would result from discontinuing the hereinafter <br />described portion of Elliott Avenue; and <br /> <br /> WHEREAS, the said viewers have reported in writing that <br />in their opinion no inconvenience would result from the <br />closing and discontinuing of said street. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City <br />of Portsmouth, Virginia, that the hereinafter-described <br />portion of Elliott Avenue be closed and vacated as a public <br />street. <br /> <br />Elliott Avenue <br /> <br /> Ail those two certain strips of land, <br />being the northern and southern 7' of the <br />present right-of-way of Elliott Avenue, as <br />said'roadway is bounded on the east by <br />Frederick Boulevard and on the west by Deep <br />Creek Boulevard. It being intended that <br />Elliott Avenue shall, retain a dedicated public <br />street uight-of-way of 66' in width as said <br />street runs between Frederick Boulevard on the <br />east and Deep Creek Boulevard on the west. <br /> <br /> BE IT FURTHER ORDAINED that the City of Portsmouth hereby <br />reserves unto itself perpetual easements, privileges and <br />rights-of-way to install, maintain, operate and replace <br />sanitary sewers, storm drains, water mains and laterals, <br />electric power lines and telephone lines within, over, under <br />and across the hereinabove-described property. <br /> <br /> BE IT FURTHER ORDAINED that the City Manager be, and h~ <br />hereby is, authorized to convey any right, title and interest <br />of the City in and to the hereinabove-described portions of <br />Elliott Avenue to the abutting property owners under such <br />terms and conditions as may be deemed acceptable to the City. <br /> <br /> <br />
