AN ~RD%NANCE TO AMEN~-T~-~CODE OF THE ~ITY OF <br />PORTSMOUTH, ~IRGINIA, 1973, BY AMENDING SECTION 40-209 <br />(b) PERTAINING TO APPEALS TO THE BOARD OF ZONING <br />APPEALS. <br /> <br /> BE IT ORDAINED by the Council of the City of <br />Portsmouth, Virginia, that Section 2.09 (b) of the Code <br />of the City of PortsmOuth, Virginia, 1973, be amended to <br />read as follows: <br /> <br />Section 40-209. Appeals. <br /> <br /> (b) An appeal shall stay all proceedings ~n <br />furtherance of the action appeal from, unless the <br />Building Official certifies to the Board, after not~ce <br />of appeal shall have been filed with him that, by reason <br />of facts stated in the certificate, a stay would, in his~. <br />opinion, cause imminent peril to life or property. In <br />such case proceedings shall not be stayed otherwise than <br />by a restraining order which may be granted by the Board <br />or by a Court o~ record on application and notice to the <br />Building Official and on due cause shown. The Board <br />shall fix a reasonable time for the hearing of the <br />appeal, give public notice thereof, as well as due <br />notice to the parties in interest, and decide ~the~same <br />within 90 days of the filing of the application or <br />appeal.
