AN ORDINANCE TO AMEND CHAPTER 23 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, 1973, AS AMENDED, BY AMENDING SECTIONS <br />23-215, 23-216, 23-278, 23-285, 23-291, AND 23-294 <br />THEREOF, AND BY ENACTING SECTION 23-295 THERETO, <br />pERTAINING TO PRIVATE AND OF~-STREET PARKING LOTS. <br /> <br /> BE IT ORDAINED by the Council of the City of <br />Portsmouth: <br /> <br /> 1. "That ~§23-215, 23-216, 23-278, 23-285 and <br />23-291 of the Code of the City of Portsmouth,.Virglnia, <br />1973, are amended to read as follows: <br /> <br />Section 23-215. Consent required to park on private <br /> property. <br /> <br /> No person shall stand or park a vehicle on any <br />private lot or 1pt area without the express or implied <br />consent of the owner, operator or lessee thereof. <br />Whenever signs or markings have been erected on any lot <br />or lot area, contiguous or adjacent to a street, <br />thoroughfare or alley permitting parking or standing of <br />vehicles, thereon only with the permission of the owner, <br />operator or lessee, or prohibiting the parking or <br />standing of vehicles thereon, it shall be unlawful for <br />any person to drive a vehicle across any curb or lot <br />line or ove.r any driveway from a street or alley into <br />such lot or area for the purpose of standing or parking <br />such vehicle, or for any person to stop, stand or park <br />any vehicle in such lot or lot area. <br /> <br />Section 23-216. Removal, storage of vehicles unlawfully <br /> parked on private property. <br /> <br /> (a) It shall be lawful for any owner, operator, or <br />lessee of any parking lot or parking area or space <br />therein or part thereof, or of any other lot or <br />building, to have any motor or other vehicle, occupying <br />such lot, area, .space or building or part thereof <br />without the permission of such owner, operator, lessee <br />or authorized agent of the one having the control of <br />such premises removed by towing, or otherwise, to a <br />licensed garage for storage until called for by the <br />owner or his agent. <br /> <br /> '(b) Any towing under the provisions of this <br />section shall not be commenced unless notice is, first <br />or simultaneously with the towing operations, given to <br />the Portsmouth Police Department. <br /> <br /> <br />
