Section 21-38. Ca~rying concealed weapons. <br /> <br /> (d) Any resident of the city may apply in writing to <br />the circuit court for the City of Portsmouth for a one-year <br />permit to carry a specific type of concealed weapon. The <br />court, after consulting the law enforcement authorities of <br />the city and receiving a report f~om the central c~iminal <br />records exchange, shall issue such permit if it finds that <br />the applicant is of good character, has demonstrated a need <br />to carry such concealed weapon, is physically and mentally <br />competent to carry such weapon and is not prohibited by law <br />from receiving, possessing, or transporting such weapon. <br /> <br /> The court shall find that the applicant has demonstrated <br />a need to carry a concealed weapon in the following <br />circumstances: <br /> <br />(1) <br /> <br />The applicant regularly transports substaniat sums <br />of money or other property of substantial value <br />from a place of business to his home or a bank or <br />other secure depository; <br /> <br />(2) <br /> <br />The court is convinced that because of bona fide <br />threats to the body or life of the applicant or to <br />the body oF life of a member of the applicant's <br />immediate family, or because of other body o~ life <br />threatening circumstances peculiar to the <br />applicant, there is probable cause to believe such <br />permit is reasonable and necessary to promote the <br />self-protection of the applicant. <br /> <br /> In all other cases the court shall have discretion to <br />determine whether need has been established. No fee shall be <br />charged fo~ the issuance of such permit to a person who has <br />retired from service as a law-enforcement office~ with the <br />department of state police, or with a sheriff or police <br />department, bureau or force of any political subdivision of <br />the Commonwealth of Virginia, afte~ completing twenty(20) <br />years service or after reaching age fifty-five(55). The <br />o~der issuing such permit shall be entered in the law order <br />book of the court. <br /> <br />Section 21-113. <br /> <br />Escape without force or violence or setting <br />fire to jail. <br /> <br /> I~ any person, lawfully confined in 3ail oF lawfully in <br />the custody of any court or officer thereof or of any <br />law-enforcement officer on a charge o~ conviction of a <br />misdemeanor, escapes otherwise than by force or violence o~ <br />by setting fire to the 3ail, he shall be guilty of a class 1 <br />misdemeanor. <br /> <br /> <br />
