(1) <br /> <br />If the~e was at that time 0.05 per cent oF less by <br />weight by volume of alcohol in the accused's blood, <br />it shall be presumed that the accused was not under <br />the influence of alcoholic intoxicants. <br /> <br />(2) <br /> <br />If there was at that time in excess of 0.05 pe~ <br />cent but less than 0.10 pe~ cent by weight by <br />volume of alcohol in the accused's blood, such <br />facts shall not give rise to any p~esumption that <br />the accused was or was not under the unfluence of <br />alcoholic intoxicants, but such facts may be <br />considered with other competent evidence in <br />determining the guilt oF innocence of the accused. <br /> <br />Section 21-38. Carrying concealed weapons. <br /> <br /> (a) If any person ca~y about his person, hidden from <br />common observation: <br /> <br />(t) Any pistol, revolver, or other weapon designed <br /> intended to p~opel a missile of any kind; <br /> <br />(2) Any di~k, bowie knife, switchblade knife, ~azoF, <br /> slingshot, metal knucks, blackjack; <br /> <br />(3) <br /> <br />Any flailing instrument consisting of two[2) or <br />more ~lgid parts connected in such a manneF as to <br />allow them to swing freely, which may be known as a <br />nun chahka, nunchuck, nunchaku, shuriken, or <br />fighting chain; or <br /> <br />(4) <br /> <br />Any disc, of whatever configuration, having at <br />least two(2) points or pointed blades which is <br />designed to be thrown or propelled and which may be <br />known as a throwing star o~ oriental dart; o~ <br /> <br />(5) Any weapon of like kind as those enumerated in this <br /> paragraph, <br /> <br />he shall be guilty of a Class 1 misdemeanor, and such weapon <br />shall be forfeited to the Commonwealth and may be seized by <br />an officer as forfeited, and such as may be needed for police <br />officers, conservators of the peace, and the Division of <br />Consolidated Laboratory Services of the Commmonwealth of <br />Virginia shall be devoted to that purpose, and the remainder <br />shall be disposed of as provided in ~18.2-310 of the Code of <br />Virginia, 1950, as amended. Fo~ purposes of this section, a <br />weapon shall De deemed to be hidden from common observation <br />when it is observable but is of such deceptive appearance as <br />to disguise the weapon's true nature. <br /> <br /> <br />
