43 A RESOLUTION GRANTING A USE PERMIT TO FIRST HOSPITAL CORPORATION TO OP~ERATE A PRIVATE SCHOOL/RESIDENTIAL TREATMENT FACILITY AT 1801 PORTSMOUTH BOULEVARD. WHEREAS, Foundation Boys Academy, by First Hospital Corporation, contract owner, has made application pursuant to §40-75 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit to operate a private school/residential treatment facility at 1801 Portsmouth Boulevard; and WHEREAS, the applicant and the done all things required to be done application; and Planning Director have in connection with said WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; and (c) Will be in accordance with the p~rposes of the zoning chapter of the City Code. 2. First Hospital Corporation is hereby granted a use permit pursuant to §40-75 (b) of the Code of the City of Portsmouth, Virginia, to operate a private school/ residential treatment facility to accommodate up to 330 overnight residents at 1801 Portsmouth Boulevard (Tax Map 233, Parcel 1), such parcel encompassing 27.9504 acres, aad being more particularly described as follows: UP-86-2 ~EGINNING at a point in the southern line of Summit Avenue which lies North 88° 32' 00" West 150.00' from the southwest corner of Summit Avenue and Lansing Avenue as shown on the aforesaid plat; thence from said point of beginning as thus established South 01° 28' 00" West 108.00'; thence South 88° 32' 00" East 25'; thence South 01° 28' 00" West 276.00'; thence South 88° 32' 00", East
