A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO ~40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, SAID PROJECT CONSISTING O~ A 4-UNIT <br />APARTMENT BUILDING AT 207 GILMERTON AVENUE AND DESIGNATED <br />AS GHP-85-36. <br /> <br />20 <br /> <br /> WHEREAS, Albert Whitley, has made application pursuant <br />to ~40-55 of the Code of the City of Portsmouth, Virginia, <br />1973, for the granting and approval of a group housing <br />project consisting of a four-unit apartment building at 207 <br />Gilmerton Avenue (Tax Plate 71, Parcel 66), which consists <br />of approximately 10,000 square feet of property; and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of ~40-55; <br />and <br /> <br /> WHEREAS, the Planning Commission has reviewed such <br />application and site plan submitted therewith and has made <br />a recommendation consisting of a conditional approval of <br />said application; and <br /> <br /> WHEREAS, the developer has been informed that approval <br />of a group housing pro3ect pursuant to ~40-55 grants only <br />an exemption from certain requirements for residences as <br />stated in said section and does not constitute a waiver of <br />any other requirement embodied in the subdivision <br />ordinance, zoning ordinance, Code of the City of <br />Portsmouth, Virginia, or any other applicable local, state <br />or federal law or regulation; and <br /> <br /> WHEREAS, 5he developer is aware that building permits <br />or any other required permit will be issued only upon <br />compliance with the ordinances, laws or regulations <br />applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia that the certain group housing <br />project consisting of a 4-unit apartment building at 207 <br />Gilmerton Avenue and designated as GHP-85-36 is hereby <br />granted approval subject to the following terms and <br />conditions: <br /> <br /> (a) The site plan to be made a part hereof is to <br />be revised so as to have parking in the rear and the <br />building setback equal to the average setback of abutting <br />properties, such revised site plan to be submitted to the <br />Engineering and Technical Services Department of the City <br />for review and approval, and same must include a sidewalk <br />along Gilmerton Avenue and the necessary up-grading of the <br />water main as required by the Department of Public <br />utilities of the City. <br /> <br /> <br />
