19 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO 940-55 OF THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, SAID PROJECT BEING KNOWN AS "ELMS WAY <br />CONDOMINIUMS" AND DESIGNATED AS GHP-85-35. <br /> <br /> WHEREAS, Metro Development Corporation, has made <br />application pursuant to 940-55 of the Code of the City of <br />Portsmouth, Virginia, 1973, for the granting and approval <br />of a group housing project consisting of twenty-eight (28) <br />units in seven (7) buildings on a 1.19 acre parcel on <br />Elmhurst Lane, approximately 150' north of its intersection <br />with Airline Boulevard ;and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of ~40-55; <br />and <br /> <br /> WHEREAS, the Planning Commission has reviewed such <br />application and site plan submitted therewith and has <br />recommended a conditional approval of said application; <br /> <br />and <br /> <br /> WHEREAS, the developer has been informed that approval <br />of a group housing project pursuant to ~40-55 grants only <br />an exemption from certain requirements for residences as <br />stated in said section and does not constitute a waiver of <br />any other requirement embodied in the subdivision <br />ordinance, zoning ordinance, Code of the City of <br />Portsmouth, Virginia, or any other applicable local, state, <br />or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware that building permits <br />or any other required permit will be issued only upon <br />compliance with the ordinances, laws or regulations <br />applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia, that the certain group <br />housing project described. ~b~ve shall be revised so as to <br />consist of twenty-four (24) units in SlX (6) buildings on a <br />1.19 acre parcel on Elmhurst Lane approximately 150' north <br />of its intersection with Airline Boulevard and designated <br />as GHP-85-35 and more specifically described in <br />correspondence from Metro Development Corporation dated <br />January 27, 1986, with enclosures, and such other <br />correspondence not inconsistent with this approval <br />previously provided by the applicant and on file with the <br />appropriate officials of the City of Portsmouth, Virginia, <br />all of the above being made a part hereof is hereby granted <br />approval subject to the following terms and conditions: <br /> <br /> <br />
