130 <br /> <br />A RESOLUTION REQUESTING THE VIRGINIA DEPARTMENT OF <br />TRANSPORTATION TO PROCEED WITH ALLOCATION OF FUNDING, DESIGN <br />AND CONSTRUCTION OF CHURCHLAND BOULEVARD FROM TOWNE POINT <br />ROAD TO HIGH STREET WEST UPGRADE TO FOUR LANES <br />DIVIDED/UNDIVIDED AS AN URBAN ROAD PROJECT. <br /> <br /> WHEREAS, by agreement dated November 14, 1986, between <br />the City of Portsmouth and the Commonwealth of Virginia, <br />Department of Transportation, certain urban road projects <br />were designated for funding, design and construction within <br />the next five years; and <br /> <br /> WHEREAS, the Virginia Department of Transportation <br />agreed, as provided by law and Board policy, to allocate <br />available urban highway funds for said projects; and <br /> <br /> WHEREAS, this Council deems it to De in the best <br />interest of the City to proceed immediately with the <br />Churchland Boulevard Project. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia, that the Virginia Department of <br />Transportation be. and it hereby is, requested to proceed <br />with allocation of funding, design and construction of <br />Churchland Boulevard from Towne Point Road to High Street <br />West upgrade to four lanes divided/undivided as an urban road <br />project, a distance of approximately 0.6 miles. <br /> <br /> BE IT FURTHER RESOLVED that the Council of the City of <br />-~---~6~t~ hereby agrees to pay it~ share of the total cost <br /> for preliminary engineering, right-of-way and construction of <br /> this project in accordance with Section 33.1-44, Code of <br /> Virginia, and that if the City subsequently decides to cancel <br /> such construction after the Department has initiated the <br /> project, the City agrees to reimburse the Department the <br /> total amount of the costs expended by the Department through <br /> the date the Department is notified of such cancellation, and <br /> provided further that the Transportation Commission shall <br /> have authority to waive all or any portion of such <br /> reimbursement at its discretion. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held December 9, 1986. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
