WHEREAS~ the Virginia Department of Highways and <br />Transportation has failed to respond in a positive <br />manner to this request and furthermore has contin~e~ the <br />administrative process of bidding and awarding contracts <br />for the project; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth <br />deems it to be in the best interest of the City to <br />construct that portion of the Western Freeway Project <br />from Cedar Lane to the West Norfolk Bridge only if <br />certain conditions hereinafter set forth are met by the <br />Virginia Department of Highways and Transportation. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of <br />the City of Portsmouth, Virginia, that the plans, <br />designs and award of contract for construction of that <br />portion of the Western Freeway Project between Cedar <br />Lane and West Norfolk Bridge be, and the same hereby <br />are, approved; provided, however, said approval is <br />subject to the following conditions: <br /> <br /> 1. That the Virginia Department of Highways and <br />Transportation obtain such approvals as may be necessary <br />to construct all additional segments of the Western <br />Freeway Project (Suffolk boundary to Cedar Lane; West <br />Norfolk Bridge to Midtown Tunnel; Martin Luther King <br />Freeway to 1-264) by interstate or primary funding or <br />designation as toll road facilities. The phases of the <br />Western Freeway Project shall be funded, designed and <br />constructed in such manner as to complete the portion of <br />the Western Freeway Project from the West Norfolk Bridge <br />to the Midtown Tunnel prior to the opening to traffic on <br />the portion of the project from the Suffolk boundary to <br />Cedar Lane. <br /> <br /> 2. That the Virginia Department of Highways and <br />Transportation take such action as may be necessary to <br />permit continual pedestrian and bicycle traffic access <br />to the West Norfolk Bridge. <br /> <br /> 3. That the Virginia Department of Highways and <br />Transportation shall take such action as may be <br />necessary to assume maihtenance responsibilities for the <br />Western Freeway and West Norfolk Bridge. Such <br />maintenance by the Virginia Department of Highways and <br />Transportation shall commence upon completion of this <br />phase of the ~roject and each and every phase <br />thereafter. <br /> <br /> 4. That the Virginia Department of Highways and <br />Transportation shall, within the next five years, <br />allocate to the City of Portsmouth sufficient urban <br />highway funds to initiate design and construction of <br /> <br /> <br />
