11t <br /> <br />A RESOLUTION APPROVING THE FINAL PLANS AND DESIGNS, AND <br />AWARD OF CONTRACT FOR CONSTRUCTION OF A PORTION O~..THE <br />WESTERN FREEWAY PROJECT FROM CEDAR LANE TO THE WEST <br />NORFOLK BRIDGE; SUBJECT TO CONDITIONS AS SET FORTH. <br /> <br /> WHEREAS, the Virginia Department of Highways and <br />Transportation has requested, as provided by law, that <br />the City Council of Portsmouth approve the award of a <br />contract and approve plans and designs for the <br />construction of a portion of the Western Freeway Project <br />from Cedar Lane to the West Norfolk Bridge; and <br /> <br /> WHEREAS, by resolution of this Council adopted <br />January 22, 1985, the City of Portsmouth instructed the <br />Virginia Department of Highways and Transportation that <br />urban highway funds were not to be allocated to this <br />project and that the Virginia Department of Highways and <br />Transportation was to provide alternate sources of <br />funding for the construction and subsequent maintenance <br />of said Western Freeway; and <br /> <br /> WHEREAS, the Virginia Department of Highways and <br />Transportation has 'failed to respond in a positive <br />manner to this request; and <br /> <br /> WHEREAS, by resolution of this Council adopted May <br />27, 1986, the City of Portsmouth instructed the Virginia <br />Department of Highways and Transportation that any <br />approvals of the City which by law may be necessary in <br />connection with any element of the Western Freeway <br />Project would not be forthcoming until the following <br />conditions have been met': <br /> <br /> 1. Resolution to the satisfaction of the City <br />Council of the Urban Funding Issue. <br /> <br /> 2. Resolution to the satisfaction of the City <br />Council of the issue of the connector between the West <br />Norfolk Bridge and Martin Luther King Freeway/Midtown <br />Tunnel. <br /> <br /> 3. Resolution to the satisfaction of the City <br />Council of the issue of priority of the construction <br />phases. <br /> <br /> WHEREAS, said resolution of May 27, 1986, also <br />instructed the Virginia Department of Highways and <br />Transportation that further implementation towards <br />construction of the JWestern Freeway Project should be <br />delayed pending the resolution of the three stated <br />issues; and <br /> <br /> <br />
