107 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE A 10' <br />DRAINAGE EASEMENT IN SECTION 3, ELIZABETH ACRES. <br /> <br /> WHEREAS, by plat recorded in Map Book 3, page 62, in the <br />Clerk's Office of the Circuit Court of the City of Portsmouth, <br />Virginia, the developer of Elizabeth Acres, Section 3 <br />dedicated a certain drainage easement, ten feet (10') in <br />width, along the boundary of lots 83 through 92 of said <br />subdivision; and <br /> <br /> WHEREAS, the owners of said lots have petitioned the City <br />of Portsmouth for release of said drainage easement; and <br /> <br /> WHEREAS, said drainage easement is no longer required in <br />connection with the comprehensive drainage plans for this area <br />of the City. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City Manager be, and he <br />hereby is, authorized to release a certain drainage easement, <br />ten feet (10') in width, located in Elizabeth Acres, Section <br />3, more particularly described as follows: <br /> <br /> Ail that certain piece or parcel of land, <br />situate, lying and being in the City of <br />Portsmouth, Virginia, being designated on the <br />Plat of Elizabeth Acres, Section 3, recorded <br />in Map Book 3, page 62, in the Clerk's Office <br />of the Circuit Court of the City of <br />Portsmouth, Virginia, as a ten foot (10') <br />strip parallel to the rear lot lines of lots <br />83 through 92, both inclusive, as shown on <br />said plat and designated as "Ten Foot Drainage <br />Easement". <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he <br />hereby is, authorized to sign such deeds or other documents as <br />may be necessary to complete this transaction. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held October 14, 1986. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
