14 A RESOLUTION GRANTING A USE PERMIT TO THE SALVATION ARMY TO OPERATE AN ADULT DAY CARE CENTER AT 2306 AIRLINE BOULEVARD. WHEREAS, the Salvation Army, a Georgia CorDoration, has made application pursuant to ~40-76 (b) of the Code of the City of Portsmouth, Virginia, as amended, for the granting of- a use permit as hereinafter-described; and WHEREAS, the applicant and the done all things required to be done application; and Planning Director have in connection with said WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) will not adversely affect safety of persons residing or working in the proposed use; the health and the neighborhood of (b) injurious to ne ig hborhood; Will not be detrimental to the public the property or improvements in the and use or (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. The Salvation Army is hereby granted a use permit pursuant to ~40-76 (b) of the Code of the City of Portsmouth, Virginia to operate as adult day care center for fifteen adults at 2306 Airline Boulevard (UP-85-34). 3. This use per--mit is approved subject to the following conditions: (a) The adult day care center may be operated with an enrollment of not more than fifteen (15) adults to be cared for at the ~acility at any one time. (b) Ail operations shall be conducted between the hours of 6:00 a. m. and 6:00 p. m. (c) A passive outdoor recreation area shall be provided and a privacy fence erected screening the recreation area from the adjoining school playground.
