95 <br /> <br />A RESOLUTION GR~TING A USE PERMIT TO BERNIE ~RD TO OPERATE <br />AN AUTOMOTIVE SERVICE STATION AT 1544 HIGH STREET. <br /> <br /> WHEREAS, Bernie Ward, operator~ has made application <br />pursuant to Section 40-121 (a) (i) of the Code of the City of <br />Portsmouth, Virginia, 1973, as amended, for the granting of a <br />use permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the <br />done all things required to be done <br />application; and <br /> <br />Planning Director have <br />in connection with said <br /> <br /> WHEREASr the Planning Commission has recommended the <br />granting of said use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) will not adversely affect the health and safety <br />of persons residing or working in the neighborhood of the <br />proposed used; <br /> <br /> (bi will not be detrimental to the public use or <br />injurious to the property or improvements in the neighborhood; <br />and <br /> <br /> (c) will be in accordance with the purposes of the <br />Zoning Chapter of the City Code° <br /> <br /> 2. Bernie Ward is hereby granted a use permit pursuant <br />to Section 40-121 (a) (i) of the Code of the City of <br />Portsmouth, Virginia, 1973, to operate an automotive service <br />station as defined in Sectio~l 40-31 of said Code at 1544 High <br />Street such property being further described as tax'map 48, <br />parcel 168. (UP-86-t0) <br /> <br /> This use permit is approved subject to the following <br />conditions: <br /> <br /> The applicant must obtain D-1 approval on any necessary <br />exterior alterations to the property. <br /> <br /> <br />
