62 <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO AUTUMN CORPORATION <br />TO OPERATE A NURSING HOME AT 3610 WINCHESTER DRIVE. <br /> <br /> WHEREAS, Durwood A. Brown, Director of Operations <br />of the Autumn Corporation, has made application pursuant <br />to §40-75 (b) of the Code of the City of Portsmouth, <br />Virginia, 1973, for the granting of a use permit as <br />hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planninq Director <br />have done all things required to be done in connection <br />with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended <br />conditional approval of said use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED Dy the Council of <br />the City of Portsmouth, Virginia: <br /> <br />sought: <br /> <br />That the use for which the use permit <br /> <br /> (a) Will not adversely affect the health and <br />safety of persons residing or working in the <br />neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use <br />or injurIous to the property or improvements in the <br />neighborhood; and <br /> <br /> (c) Will be in accordance with the purposes <br />of the Zoning Chapter of the City Code. <br /> <br /> 2. Autumn Corporation is hereby granted a use <br />permit pursuant to ~40-75 (b) of the City Code to <br />operate a nursing home at 3610 Winchester Drive further <br />described as Tax Map 330, Parcels 29, 31, 33 and 36. <br /> <br /> 3. The use permit is approved subject to the <br />following conditions: <br /> <br /> (a) Ail applicable state and local licenses <br />must be obtained prior to operation. <br /> <br /> (b) Ail building, fire and health code <br />requirements must be satisfied prior to operation. <br /> <br /> (c) No more than one hundred eight (108) <br />patients may be care for at the facility at any one <br />time. <br /> <br /> <br />
