AN ORDINANCE TO AMEND SECTION 6-8 OF CHAPTER 6 OF THE CODE OF <br />THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS AMENDED, PERTAINING <br />TO BUILDINGS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 6-8 Subsection 118.41 (7) be amended to <br />read as follows: <br /> <br />Section 6-8 Subsection 118.41 (7). <br /> <br /> It shall be the duty of the moving contractor to give <br />good and sufficient bond in the penal sum of Fifty Thousand <br />Dollars ($50,000.00), to be approved by the Department of Law <br />of the City of Portsmouth, payable to the City of Portsmouth, <br />Virginia, a municipal corporation, with surety conditioned to <br />indemnify and save harmless the City from all expense and <br />damage that may be caused by any negligent, defective or <br />inadequate work or any act done as a result of the moving of <br />any building or structure and/or against any and all claims, <br />actions or causes of action which may accrue as a result <br />thereof and to secure and insure said moving contractor's <br />conformation and compliance with the regulations of the <br />Building Official and the Building Code and other ordinances <br />or laws of this City. In addition to liability for any <br />damages or indemnification, to the City of Portsmouth or to <br />any person by reason of such negligence or defective or <br />inadequate work, when any work done by said moving contractor <br />shall be deemed defective or inadequate or to be not in <br />conformation nor in compliance with the regulations of the <br />Building Official or the Building Code or other ordinances or <br />laws of this City, and said contractor shall fail to revise or <br />put such work in proper condition or comply with any <br />regulation, Code, ordinance or law to the satisfaction of the <br />Building official within seven days after written notification <br />to the ccntractor's address as provided by the contractor at <br />the time of making application for a certificate of use and <br />occupancy for the new location, the bond shall be forfeited <br />and the principal and surety on such bond shall be and become <br />liable to the City of Portsmouth, Virginia, and/or to any <br />person for damages sustained, for the sum of Fifty Thousand <br />Dollars ($50,000.00). <br /> <br /> 2. That this ordinance shall take effect on the date of <br />its adoption. <br /> <br /> <br />
