AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTIONS 11-104; 11-1081 11-127; <br />11-128; AND 11-129 (4) PERTAINING TO PUBLIC PROCUREMENT. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia, that: <br /> <br /> 1. That Section 11-108 of the Code of the City of <br />Portsmouth, Virginia, be amended no read as follows: <br /> <br />Section 11-108. Competitive sealed bidding. <br /> <br /> Ail public contracts with nongovernmental contractors <br />for the purchase or lease of good or the purchase of <br />services, insurance, or construction shall be awarded after <br />competitive sealed bidding or competitive negotiation as <br />provided by this article. <br /> <br /> No contract for the construction of any building or for <br />an addition, or improvement of an existing building for which <br />State funds of Ten Thousand Dollars ($10,000.) or more, <br />either by appropriation, grant-in-aid or loan are used or to <br />be used for all or part of the cost of the construction shall <br />be let except after competitive sealed bidding, excepn that <br />competitive negotiation may be used for construction <br />contracts in the following instances upon a determination <br />made in advance by the purchasing agent and set forth in <br />writing that competitive sealed bidding is either not <br />practicable or not fiscally advantageous to the public, which <br />writing shall document the basis for this determination: <br /> <br /> (i) For the alteration, repair, renovation or <br />demolition of buildings when the contract is not expected <br />cost more than $500,000.; or <br /> <br />to <br /> <br /> (ii) <br />dredging, <br />property; <br /> <br />For the construction of highways and any drainage, <br />excavation, grading or similar work upon real <br /> <br /> The procedure for advertising for bids or for proposals <br />and for letting of the contract shall conform, mutatis <br />mutandis, to this chapter. A person or firm who has been <br />engaged as an architect or engineer for the same project <br />under a separate contract shall not be eligible to bid on or <br />submit a proposal for any such contract or to have the <br />contract awarded to him or it. <br /> <br /> 2. That Section 11-127 of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended to read as follows: <br /> <br /> <br />
