]987=55 <br /> <br />AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTIONS 23-216, 23-233(a), <br />23-365, 23-366(a), 23-389, 23-390, and 23-478 OF CHAPTER <br />THEREOF, PERTAINING TO MOTOR VEHICLES. <br /> <br />23 <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />PORTSMOUTH, VIRGINIA: <br /> <br /> 1. That Sections 23-216, 23-233 (a), 23-365, 23-366 <br />(a), 23-389, 23-390, and 23-478 of Chapter 23 of the Code <br />of the City of Portsmouth, Virginia, 1973, be amended to <br />read as follows: <br /> <br />Section 23-216. <br /> <br />Removal, storage of vehicles unlawfully <br />parked on private property. <br /> <br /> (a) It shall be lawful for any owner, operator or <br />lessee of any parking lot or parking area or space therein <br />or part thereof, or of any other lot or building, to have <br />any motor or other vehicle, occupying such lot, area, space <br />or building or part thereof without the permission of such <br />owner, operator, lessee or authorized agent of the one <br />having the control of such premises removed by towing, or <br />otherwise, to a licensed garage for storage until called <br />for by the owner or his agent. <br /> <br /> (b) Any towing under the provisions of this section <br />shall not be commenced unless notice is, first or <br />simultaneously with the towing operations, given to the <br />Portsmouth Police Department. <br /> <br /> (c) In the event of such removal and storage, the <br />owner of the vehicle involved shall be chargeable with and <br />such vehicle may be held for a reasonable charge for its <br />removal and storage. However, if the owner of the <br />trespassing vehicle is present and removes the trespassing <br />vehicle from the premises before it is actually towed, the <br />trespassing vehicle shall not be towed, but the owner of <br />the trespassing vehicle shall be liable for a fee of <br />twenty-five ($25.00) dollars, in lieu of towing. <br /> <br /> (d) The provisions of subsection (a) shall not apply <br />to police, lire or public health vehicles or when a vehicle <br />shall, because of a wreck or other emergency, be parked or <br />left temporarily upon the property of another. <br /> <br /> (e) Ail businesses engaged in towing vehicles without <br />the consent of their owners shall prominently display a <br />comprehensive list of all fees for towing, recovery, and <br />storage services, or the basis of such charges. Charges in <br />excess of those posted shall not be collectible from any <br /> <br /> <br />
