A RESOLUTION GRANTING A USE PERMIT TO ROBERT L. TURNER <br />FOR SIX TOWNHOUSE UNITS AT THE NORTHWEST CORNER OF <br />PORTSMOUTH BOULEVARD AND CHESTNUT STREET (UP-86-13). <br /> <br /> WHEREAS, Robert L. Turner has made application <br />pursuant to ~40-75 (b) for a use permit to construct six <br />(6) townhouse units on approximately .46 of an acre of <br />vacant property at the northwest corner of the <br />intersection o~ Portsmouth Boulevard and Chestnut Street <br />(Tax Map 59, Parcel 145); and <br /> <br /> WHEREAS, the applicant and the Planning Director <br />have done all things required to be done in connection <br />with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended <br />the granting of a use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of <br />the City of Portsmouth, Virginia: <br /> <br />1o That the use for which the use permit is <br />sought: <br /> <br /> (a) Will not adversely affect the health and <br />safety of persons residing In the neighborhood of the <br />proposed use; <br /> <br /> (b) Will not be detrimental to the public <br />or injurious to the property or improvements in the <br />neighborhood; and <br /> <br />use <br /> <br /> (c) Will be in accord with the purposes of <br />the Zoning Chapter of the~[City Code. <br /> <br /> 2. Robert L. Turner is hereby granted a use <br />permit pursuant to §40-75 (b) for six (6) townhouse <br />units to be constructed at the northwest corner of the <br />intersection of Portsmouth Boulevard and Chestnut <br />Street, said property being further described as Tax Map <br />59, Parcel 145. <br /> <br /> 3. This use permit is approved subject to the <br />following_conditions: <br /> <br /> (a) A landscape plan must be submitted to the <br />Planning Department for review and approval. <br /> <br /> (b) A Homeowners Association shall be <br />established to assure continuity of maintenance of the <br /> <br /> <br />
