in plans prepared by Horton and Dodd, P. C. designated <br />"Chestnut Court Apartments" filed with the appropriate <br />officials of the City of Portsmouth, Virginia, such <br />being made a part hereof, is hereby granted approval <br />subject to the following terms and conditions: <br /> <br /> (1) A Homeowners Association shall be established <br />to assure continuity of maintenance of the parking lot, <br />grounds, exterior of the buildings and driveway <br />entrance, and the documents estaDlishing same shall be <br />submitted to the City Attorney for review and approval <br />prior to the issuance of occupancy permits. <br /> <br /> (2) An instrument in form approved by the City <br />Attorney duly executed and acknowledged which subjects <br />each parcel to an ingress and egress easement to ensure <br />access to all units shall be properly recorded in the <br />Clerk's Office of the Circuit Court of the City of <br />Portsmouth, Virginia and the same shall be submitted to <br />the City Attorney for review and approval. <br /> <br /> (3) A standard site improvement plan shall be <br />submitted to the Department of Engineering and Technical <br />Services for review and approval. <br /> <br /> Adopted Dy the Council of the City of Portsmouth, <br />Virginia at a meeting held January 13, 1987. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
