A RESOLUTION GRANTING A USE PERMIT TO THE VIRGINIA DISTRICT <br />CONVOCATION OF UNITED HOLY CHURCH OF AMERICA, INC. TO <br />OPERATE A CHILDCARE CENTER AT THE FORMER TRUXTUN ELEMENTARY <br />SCHOOL. <br /> <br /> WHEREAS, the Virginia District Convocation of United <br />Holy Church of America, Inc. by Jasper T. Davis, <br />consultant, has made application pursuant to ~40-75 (b) of <br />the Code of the City of Portsmouth, Virginia, 1973, for the <br />granting of a use permit to operate a childcare center; and <br /> <br /> WHEREAS, the applicant and the Planning Director have <br />done all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth, <br />Virginia adopted a resolution on June 24, 1986 (UP-85-16) <br />granting a use permit to the applicant for a smaller <br />daycare center on the same site and the applicant has <br />revised his plan and relocated the daycare facility to a <br />larger portion of the former Truxtun Elementary School <br />facility. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and <br />safety of persons residing or working in the neighborhood <br />of the proposed use; <br /> <br /> (b) Will not be detrimental to <br />injurious to the property or improvements <br />neighborhood; and <br /> <br />the public use or <br />in the <br /> <br /> (c) will be in accordance with the purposes of <br />the Zoning Chapter of the City Code. <br /> <br /> 2. The Virginia District Convocation of the United <br />Holy Church of America, Inc. is hereby granted a use permit <br />pursuant to ~40-75 (b) of the City Code to operate a <br />childcare center at the former Truxtun Elementary School <br />which is located on the north side of Elliott Avenue <br />between Deep Creek and Frederick Boulevards and described <br />as Tax Plate 151, Parcel 3 (UP-87-3). <br /> <br /> 3. This use permit is approved subject to the <br />following conditions: <br /> <br /> <br />
