A RESOLUTION GRANTING A USE PERMIT TO THE VIRGINIA DISTRICT CONVOCATION OF UNITED HOLY CHURCH OF AMERICA, INC. TO OPERATE A CHILDCARE CENTER AT THE FORMER TRUXTUN ELEMENTARY SCHOOL. WHEREAS, the Virginia District Convocation of United Holy Church of America, Inc. by Jasper T. Davis, consultant, has made application pursuant to ~40-75 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit to operate a childcare center; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit; and WHEREAS, the Council of the City of Portsmouth, Virginia adopted a resolution on June 24, 1986 (UP-85-16) granting a use permit to the applicant for a smaller daycare center on the same site and the applicant has revised his plan and relocated the daycare facility to a larger portion of the former Truxtun Elementary School facility. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to injurious to the property or improvements neighborhood; and the public use or in the (c) will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. The Virginia District Convocation of the United Holy Church of America, Inc. is hereby granted a use permit pursuant to ~40-75 (b) of the City Code to operate a childcare center at the former Truxtun Elementary School which is located on the north side of Elliott Avenue between Deep Creek and Frederick Boulevards and described as Tax Plate 151, Parcel 3 (UP-87-3). 3. This use permit is approved subject to the following conditions:
