113 <br /> <br />A RESOLUTION ENDORSING THE ESTABLISHMENT OF AN INDEPENDENT <br />POLICY BOARD FOR THE SOUTHEASTERN VIRGINIA ALCOHOL SAFETY <br />ACTION PROGRAM. <br /> <br /> WHEREAS, the Commonwealth of Virginia in the interest of <br />highway safety has provided by law programs for probation, <br />education and rehabilitation of persons charged with driving <br />motor vehicles under the influence of alcohol beverages and <br />other self-administered drugs, such programs being <br />collectively known as Virginia Alcohol Safety Action Program <br />or VASAP; and <br /> <br /> WHEREAS, the Southeastern Virginia Alcohol Safety Action <br />Program was established on July 1, 1975 for the purpose of <br />providing probation, education and rehabilitation of persons <br />charged with or in violation of ~18.2-266 and/or local <br />ordinances adopted in accordance therewith; and <br /> <br /> WHEREAS, the applicable provisions of the Code of <br />Virginia requires the establishment of a VASAP Commission and <br />that Commission establish procedures for the operation of <br />local Alcohol Safety Action Programs; and <br /> <br /> WHEREAS, the VASAP Commission in its meeting on April 3, <br />1987, issued directives that all local VASAP Programs would <br />immediately establish and implement an independent Policy <br />Board Representative of all localities served by the Program <br />to operate the Program; and <br /> <br /> WHEREAS, by resolution of the Council of the City of <br />Portsmouth, Virginia, the City of Portsmouth became part of <br />the Southeastern Virginia Alcohol Safety Action Program <br />pursuant to ~15.1-21 of the Code of Virginia. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the Council of the <br />City of Portsmouth, Virginia, endorses the establishment of an <br />Independent Policy Board for the Southeastern VASAP and that: <br /> <br /> 1. The Board shall consist of fifteen (15) members. One <br />person appointed by the governing body of each participating <br />jurisdiction for a term of at least two (2) years; <br /> <br /> 2. The balance of the Board shall be selected by <br />majority vote of appointed members to serve terms of one (1) <br />year each and shall include persons representing education, <br />police, courts and citizens; <br /> <br /> 3. The Program shall be operated by the Policy Board in <br />compliance with the Commission policies and procedures and <br />local mandates; <br /> <br /> <br />
