1!1 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE A <br />UTILITY EASEMENT LOCATED IN FIFTH STREET BETWEEN HARRISON <br />STREET AND HENRY STREET. <br /> <br /> WHEREAS, by resolution adopted by the Council of the <br />City of Portsmouth, Virginia, on June 23, 1987, that portion <br />of Fifth Street between Harrison Street and Henry Street was <br />closed and vacated as a public street; and <br /> <br /> WHEREAS, at the time of said action by City Council it <br />was necessary to retain an easement for public utilities <br />until such time as the new sewage pumping station in the Port <br />Centre Commercial Complex had been constructed; and <br /> <br /> WHEREAS, said sewage pumping station has been <br />constructed and accepted by the City; and <br /> <br /> WHEREAS, the easement retained in Fifth Street is no <br />longer necessary for public utility purposes. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia, that the City Manager be, and <br />he hereby is, authorized to release the public utility <br />easement located on the following described property, to-wit: <br /> <br /> Ail that certain piece or parcel of land, <br />situate, lying and being in the City of <br />Portsmouth, Virginia, being more particularly <br />described as that portion of Fifth Street <br />bounded on the north of the southern side of <br />Harrison Street and bounded on the south by <br />the northern side of Henry Street. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he <br />hereby is, authorized to sign such deeds and other documents <br />as may be necessary to carry out the intent of this <br />resolution. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held November 24, 1987. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
