A RESOLUTION APPROVING A REVISION TO A GROUP ~OUSING PROJECT APPROVED PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, ON JULY 23, 1985, SAID PROJECT CONSISTING OF FORTY-EIGHT UNITS OF HOUSING FOR THE ELDERLY ON 1.75 ACRES WEST OF MARTIN AVENUE AND SOUTH OF PORTSMOUTH BOULEVARD AND DESIGNATED AS GHP-85-23. WHEREAS, George Eberwine has made application pursuant to ~40-55 of the Code of the City of Portsmouth, Virginia, 1973, for the granting and approval of a revision to group housing project GHP-85-23; and WHEREAS, the proposed revision provides for modification of the perimeter fence surrounding the Heritage II Group Housing Project for the elderly; and WHEREAS, the Council of the City of Portsmouth, VirginIa, by a resolution adopted July 23, 1985, granted approval for that certain group housing project consisting of forty-eight (48) rental apartment units for the elderly to be located on a 1.75 acre vacant parcel one hundred fifty (150) feet west of Martin Avenue and south of Portsmouth Boulevard and designated as GHP-85-23, and the applicant has proceeded with the construction of said ~esidential project in accordance with said plans and now requests a modification of the perimeter fence surrounding the project; and WHEREAS, the developer is aware that approval of the revision requested will merely authorize the developer to modify the requirement that a six (6) foot wooden stockade fence be built around the perimeter of the property and that this revision would not constitute a waiver of any other requirement embodied in the Subdivision Ordinance, Zoning Ordinance, or Code of the ~lty of Portsmouth, Virginia, or any other applicable local, state or federal law or regulation. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the curtain group housing project designated as GHP-85-23 as approved by the Council of the City of Portsmouth by resolution dated July 23, 1985, is hereby revised so as to permit a revision to the approved landscaping plan so as to permit the installation of a chain link fence on the south side of the project and a low vegetative hedge to be approved by the Planning staff on the north side of the project. BE IT FURTHER RESOLVED that all remaining terms and conditions of the group housing project as approved by said resolution shall remain in full force and effect.
