10 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT CONSISTING OF <br />SEVENTY-TWO (72) RENTAL APARTMENTS FOR THE ELDERLY EAST OF <br />HAYSOM STREET AND SOUTH OF PORTSMOUTH BOULEVARD AND <br />DESIGNATED AS (G~P-86-8). <br /> <br /> WHEREAS, Haysom Stree5 Associates has made application <br />pursuant to §40-55 of the Code of the City of Portsmouth, <br />Virginia, 1973, as amended, for the granting and approval <br />of a group housing project consisting of seventy-two (72) <br />rental apartments to be designated as housing for the <br />elderly as defined in ~40-31 of the Code of the City of <br />Portsmouth, Virginia, 1973, as amended, to be constructed <br />on 2.47 acres of property east of Haysom Street and south <br />of Portsmouth Boulevard (Tax Map 446, Parcel 0141), which <br />parcel is more particularly described as follows: <br /> <br />GHP-86-8 <br /> <br /> BEGINNING on the south right-of-way <br />of Portsmouth Boulevard 477.86' southeast <br />from its intersection with Haysom Street <br />and thence southwest 549.97' to establish <br />the true point of beginning; thence south- <br />west 483.14'; thence southwest 112.34'; <br />thence northwest 120.50'; thence northerly <br />356.25'; thence easterly 190.74' to the <br />True Point of Beginning. <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of §40-55 <br />of the Code of the City of Portsmouth, Virginia, 1973, as <br />amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such <br />application and site plans submitted therewith and has <br />recommended a conditional approval of the application; and <br /> <br /> WHEREAS, the developer has been informed that approval <br />of a group housing pro3ect pursuant to ~40-55 grants only <br />an exemption from certain requirements for residences as <br />stated in said section and does not constitute a waiver of <br />any other requirement embodied in the Subdivision <br />ordinance, Zoning Ordinance, code of the City of <br />Portsmouth, Virginia, or any other applicable local, state <br /> <br />or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware <br />or any other required permit will be <br />compliance with the ordinances, laws, <br />applicable thereto. <br /> <br />that building permits <br />issued only upon <br />or regulations <br /> <br /> <br />
