null and void. <br /> <br />The approval of the final subdivision plat shall <br />not ~come finally effective until the subdivider <br />has made, or provided for, the improvements <br />required pursuant to Article II of this Chapter ~o <br />the satisfaction of the City Engineer. <br /> <br />33--56 APPEALS <br /> <br />In the event that the Planning Commission fails to approve or <br />disapprove the pz~timinary plat within sixty days after it <br />has Peen officially submitted for approval, the applicant <br />may, after ten days' written notice to the Commission, <br />petition the circuit court in accordance with Virginia Code <br />Section 15.1-475 (!950, as amended). <br /> <br />If the Planning Commission disapproves a final plat and the <br />applicant desires to contest the disapproval, the applicant <br />may petition the circuit court pursuant to and in accordance <br />with Virginia Code Section 15.1--475 (1950, ss amended). <br /> <br />33-57 RECORDATION <br /> <br />Unless the subdivider shall record his approved final sub-- <br />division plat in the office Of the clerk of the circuit court <br />of the City within six (6) months after final approval as <br />provided in Article II, said final plat approval shall De <br />null and void. The subdivider or his agent shall provide the <br />Planning Director with a copy of the recordation receipt from <br />the oterk of the circuit court. <br /> <br />33-58 MINOR SUBDIVISION PROCEDURE <br /> <br />The Planning Director may certify a subdivision or a resub-- <br />division pla% as a minor subdivision if he finds that it <br />meets the standards for minor subdivisions set forth in <br />Article II of this Chapter. <br /> <br />Each applicant for minor subdivision approval shall presen~ s <br />plan for the same ~o the Planning Director.
