AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, BY AMENDING SECTION 33-55 (c), (e) AND (f) AND BY <br />ADDING SECTION 33-55 (L) PERTAINING TO SUBDIVISION UTILITY AND <br />STREET IMPROVEMENTS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia, that: <br /> <br /> 1. That Section 33-55 (c), (e) and (f) of the Code of <br />the City of Portsmouth be amended to read as follows: <br /> <br />Section 33-55. Utility and street improvements. <br /> <br /> (c) A drainage system shall be provided to ensure <br />adequate drainage of both natural and storm water. The system <br />shall be coastructed and installed in accordance with plans <br />and specifications approved by the City EngIneer. The <br />subdividor shall be required to install necessary drainage <br />facilities located outside the property limits of the land <br />owned or controlled by the subdividor but necessitated, at <br />least in part, by the construction or improvement of the <br />subdivision. <br /> <br /> (e) Waterlines shall be installed by the subdividor in <br />accordance with plans and specifications approved by the <br />Director of Public Utilities. The subdividor shall be <br />required no install necessary water facilities located outside <br />the property limits of the land owned or controlled by the <br />subdividor but necessitated, at least in part, by the <br />construction or improvemen~ of the subdivision. <br /> <br /> (f) Sanitary sewage shall be installed by the subdividor <br />in accordance with plan and specifications approved by the <br />Director of Public Utilities. The subdividor shall be <br />required to install necessary sanitary sewage facilities <br />located outside the property limits of the land owned or <br />controlled by the subdividor but necessitated, at least in <br />part, by the construction or improvement of the subdivision. <br /> <br /> 2. That Section 33-55 of the Code of the City of <br />Portsmouth be amended by adding Subsection (L) thereto to <br />as follows: <br /> <br />read <br /> <br />Subsection 33-55. Utility and street improvements. <br /> <br /> (L) If a subdividor makes an advance of payments for or <br />construction of reasonable and necessary road improvements <br />located outside the property limits of the land owned or <br />controlled by the subdividor, the need for which is <br />substantially generated and reasonably required by the <br /> <br /> <br />
