AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTION 33-55 (g) THEREOF, <br />PERTAINING TO SIDEWALK INSTALLATION REQUIREMENTS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 33-55 (g) of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended to read as follows: <br /> <br />Section 33-55. Utility and street improvements. <br /> <br /> (g) Sidewalks, at least five (5') feet in width, shall b <br />installed on both sides of all arterial and collector streets. <br />Sidewalks, at least five (5') feet in width, shall be <br />installed along all street frontage planned for apartments or <br />townhouses. <br /> <br /> Sidewalks, at least four (4') feet in width, shall be <br />required along both sides of all minor and cul-de-sac streets, <br />provided, however, the Planning Commission may reduce the <br />requirement on any minor street or cul-de-sac where the <br />Commission finds that one or more of the following criteria <br />have been met: (i) the minor streets or cul-de-sacs will have <br />ten (10) or less platted lots, or, (ii) the lots will be <br />larger than one half acre in size, or, (iii) where natural <br />features are worthy of preservation, provided further, <br />however, that under each basis of exemption noted herein the <br />Planning Commission must also find that such reduction will <br />not create a pedestrian safety hazard. <br /> <br /> Sidewalks shall be installed in accordance with plans <br />specifications of the City. Commercial and industrial <br />subdivisions may be exempted from the requirements of this <br />section if no substantial pedestrian safety hazard will be <br />created thereby. <br /> <br />and <br /> <br /> 2.
