AN ORDINANCE TO ~4END CHAPTER 23 OF THE CODE OF tHE CITY OF <br />PORTSMOUTH, VIRGIN[A, 1973, BY AMENDING SECTIONS <br />23-~,23-66.1, 23-89, 23-365, 23-389, 23-505, AND 23-506 <br />THEREOF, PERTAINING TO MOTOR VEHICLES AND TRAFFIC. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 23-389 of the Code of the City of <br />Portsmouth be amended by adding thereto Subsection (e) to <br />read as follows: <br /> <br />Section 23-389. Signs on windshields, etc. <br /> <br /> (e). Notwithstanding the foregoing provisions of this <br />section, sunshading material which was applied or ins~alle~ <br />prior to July 1, 1987, in a manner and on vehicle windows not <br />then in violation of Virginia law, shall continue to be <br />lawful, provided that it can be shown by appropriate receipts <br />or other evidence that such material was installed prior to <br />July 1, 1987. <br /> <br /> 2. That Sections 23-1, 23-66.1, 23-89, 23-365, 23-505, <br />and 23-506 be amended to read as follows: <br /> <br />Section 23-1. Definitions. <br /> <br /> (a) The words and phrases used in this chapter shall, <br />for the purposes of this chapter, have the meanings <br />respectively ascribed to them in Section 46.1-1 of Chapter 1 <br />of Title 46.1 of the Code of Virginia, 1950, as amended and <br />effective July 1, 1988, except in those instances where the <br />context clearly indicates a different meaning. <br /> <br /> (b) The terms "chauffeur's,'license" and "operator's <br />license," as used within this Chapter, shall mean any <br />license, issued under the laws of the commonwealth <br />authorizing the operation of a motor vehicle. <br /> <br /> (c) The term "State" or "state", as used within this <br />chapter, shall mean the Commonwealth of Virginia. <br /> <br />Section 23-66.1. Disregarding signal to stop by police <br /> officers. <br /> <br /> Any person who, having received a visible or audible <br />signal from any police officer to bring his motor vehicle in <br />a willful or wanton disregard of such signal so as to <br />interfere with or endanger the operation of the police <br />vehicle or endanger other property or person or who shall <br />increase his speed and attempt to escape or elude such police <br />officer shall be guilty of a Class 1 misdemeanor.
