56 A RESOLUTION GRANTING A USE PERMIT TO NATIONAL WELDERS SUPPLY INC. TO OPERATE A FACILITY FOR THE STORAGE, DISTRIBUTION AND SALE OF NON-FLAMMABLE GASES ON PROPERTY AT 3121 VICTORY BOULEVARD. WHEREAS, the Portsmouth Industrial Development Authority, on behalf of National Welders Supply Inc., has made application pursuant to §40-68 (b) of the Code of the City of Portsmouth, Virginia, as amended, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not affect the health and safety of persons residing or working in the neighborhood of the proposed use; injurious and (b) Will not be detrimental to to the property or improvements the public use or in the neighborhood; (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. That National Welders Supply Inc. is hereby granted a use permit pursuant to ~40-68 (b) of the Code of the City of Portsmouth, Virginia to operate a facility for the storage of oxygen and other non-flammable gases in quantities not exceeding five hundred thousand (500,000) cubic feet and not within one hundred (100) feet of any plot line; nor exceeding two hundred (200) cubic feet if the pressure is greater than one hundred (100) pounds per square inch but not within fifty (50) feet of any plot line at 3121 Victory Boulevard (Tax Map 493, Parcel 7), such parcel being designated as Parcel F on the plat of Beechdale Commerce Park (UP-88-11).
