46 A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1988, SAID PROJECT CONSISTING OF SIXTEEN APARTMENT UNITS AT 2012-2020 GREENWOOD DRIVE AND DESIGNATED AS GHP-89-3. WHEREAS, J. R. Williams and Angelia McCotter has made application pursuant to ~40-55 of the Code of the City of Portsmouth, Virginia, 1988, for the granting and approval of a group housing project consisting of sixteen (16) apartment units at 2012-2020 Greenwood Drive; and WHEREAS, the application has been determined by the Planning Commission to have met the requirements of ~40-55 of the Code of the City of Portsmouth, Virginia; and WHEREAS, the Planning Commission has reviewed such application and site Plans submitted therewith and has recommended conditional approval of said application; and WHEREAS, the developer has been informed that approval of the group housing project pursuant to ~40-55 grants only an exemption from certain requirements for residences as stated in said section and does not constitute a waiver of any other requiremen~ embodied in'the Subdivision Ordinance, Zoning · Ordinance, Code of the City of Portsmouth, Virginia, or any other applicable local, state or federal law or regulation; and WHEREAS, the developer is aware that building permits or any other required permit will be issued only upon compliance with the ordinances, laws or regulations applicable thereto. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the certain group housing project consisting of sixteen (16) apartment units at 2012-2020 Greenwood Drive (Tax Map 468, Parcels 5 and 6) which contains approximately 0.97 acres and designated as GHP-89-3, as shown on plans filed with the appropriate officials of the City of Portsmouth, such plans being made a part hereof is hereby granted approval subject to the following terms and conditions: (1) The group housing project shall be constructed in accordance with the site plan designated as Exhibit 1/GHP-89-3 filed with the appropriate officials of the City of Portsmouth, Virginia. (2) A revised site plan, landscaping plan and elevations, reflecting all changes and conditions imposed through the group housing project application process must be submitted to the Planning Department for review and approval prior to issuance of building permits.
