31 A RESOLUTION GRANTING A USE PERMIT TO THE NEW COMMUNITY CHURCH OF GOD IN CHRIST TO OPERATE A CHILD DAYCARE CENTER AT 3615 TYRE NECK ROAD. WHEREAS, the New Community Church Of God In Christ, by Bishop Ted Thomas, Sr., Minister, has made application pursuant to ~40-75 (b) of the Code of the City of Portsmouth, 1973, as amended, granting a use permit as hereinafter-described; and WHEREAS, the applicant and the done all things required to be done application; and Planning Director have in connection with said WHEREAS, the Planning Commission has recommended the granting of said use permit, with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: (1) That the use for which the use permit hereinafter-described is sought: (a) Will not adversely of persons residing or working in proposed use; affect the health and safety the neighborhood of the in]urious and (b) Will not be detrimental to to the property or improvements the public use or in the neighborhood; (c) Will be in accordance with the purposes of the zoning chapter of the City Code. 2. The New Community Church of God In Christ is hereby granted a use permit pursuant to ~40-75 (b) of the Code of the City of Portsmouth, Virginia, 1973, to operate a child daycare center at 3615 Tyre Neck Road, said property being further described as Tax Map 825, Parcels 63 and 64, the activity to be conducted in a newly constructed addition to the New Community Church Of God In Christ at said location. 3. The use permit is approved subject to the following conditions: (a) The child daycare center may be operated with an enrollment of not more than twenty (20) children to be cared for at the facility at any one time. Only children two and one-half (2-1/2) years of age and over may be cared for at the facility.
