22 A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE A UTILITY EASEMENT. (WESTMORELAND AVENUE) WHEREAS, by ordinance adopted by the Council of the City of Portsmouth, Virginia, at a meeting held August 25, 1987, designated as Ordinance 1987-86, a portion of Westmoreland Avenue between Clifford Street and Bart Street was closed and vacated as a public street; and WHEREAS, by said ordinance, the City of Portsmouth retained an easement on the western thirty feet of said street for installation, operation and maintenance of water mains and lines; and WHEREAS, the City has subsequently terminated the said water lines and no longer has a requirement for said easement; and WHEREAS, the adjoining property owner has requested a release of said easement. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that the City Manager be, and he hereby is, authorized to release the utility easement retained by the above-referenced ordinance over, unde~ and across the following described property, to-wit: Ail that certain piece or parcel of land, situate, lying and being in the City of Portsmouth, Virginia, being more particularly described as the remaining portion of Westmoreland Avenue bounded on the west by lot 2, block 62, and bounded on the east by lot 24, block 61, as shown on the plat of Virginia Realty and Investment Company and being 108.5' x 60' in dimensions. BE IT FURTHER ORDAINED that the City Manager be, and he hereby is, authorized to sign such deeds and other documents as may be necessary to carry out the intent of this resolution.
