21 <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO EARL J. COOK, SR. TO <br />OPERATE A JUNKYARD AT 703-705 JAMESTOWN AVENUE AND AT 705-707 <br />YORKTOWN AVENUE. <br /> <br /> %~HEREAS, Earl J. Cook, Sr. had been granted a use permit <br />to operate a junkyard at 703-705 Jamestown Avenue by <br />Resolution 82-50 adopted by the Council of the City of <br />Portsmouth, Virginia at a meeting held June 22, 1982 an~ <br />designated as UP-82-12; and <br /> <br /> WHEREAS, Earl J. Cook, Sr. had been granted a use permit <br />to operate an auto junkyard at 705-707 Yorktown Avenue by <br />resolution 1983-90 adopted by the Council of the City of <br />Portsmouth, Virginia at a meeting held September 27, 1983 and <br />designated as UP-83-6; and <br /> <br /> WHEREAS, the use permits noted above expired on June 30, <br />1987, and Earl J. Cook, Sr. has made application pursuant to <br />~40-69 (b) of the Code of the City of Portsmouth, Virginia, <br />1973 for the granting of a use permit as hereinafter-described <br />for both parcels of land noted above; and <br /> <br /> WHEREAS, the applicant and the <br />done all things required to be done <br />application; and <br /> <br />Planning Director have <br />in connection with said <br /> <br /> WHEREAS, the Planning Commission has made a <br />recommendation regarding the granting of said use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> (1) That the use for which the use permit <br />hereinafter-described ls sought: <br /> <br /> (a) Will not adversely affect the health and safety <br />of persons residing or working in the neighborhood of the <br />proposed use; <br /> <br />injurious <br />and <br /> <br />(b) Will not be detrimental to the public use or <br />to the property or improvements of the neighborhood; <br /> <br /> (c) Will be in accordance with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> (2) Earl J. Cook, Sr. is hereby granted a use permit <br />pursuant to ~40-69 (b) of the Code of the City of Portsmouth, <br />Virginia to operate a junkyard at the two parcels more <br />particularly described below, such parcels containing <br />approximately .96 acres: <br /> <br /> <br />
