21 A RESOLUTION GRANTING A USE PERMIT TO EARL J. COOK, SR. TO OPERATE A JUNKYARD AT 703-705 JAMESTOWN AVENUE AND AT 705-707 YORKTOWN AVENUE. %~HEREAS, Earl J. Cook, Sr. had been granted a use permit to operate a junkyard at 703-705 Jamestown Avenue by Resolution 82-50 adopted by the Council of the City of Portsmouth, Virginia at a meeting held June 22, 1982 an~ designated as UP-82-12; and WHEREAS, Earl J. Cook, Sr. had been granted a use permit to operate an auto junkyard at 705-707 Yorktown Avenue by resolution 1983-90 adopted by the Council of the City of Portsmouth, Virginia at a meeting held September 27, 1983 and designated as UP-83-6; and WHEREAS, the use permits noted above expired on June 30, 1987, and Earl J. Cook, Sr. has made application pursuant to ~40-69 (b) of the Code of the City of Portsmouth, Virginia, 1973 for the granting of a use permit as hereinafter-described for both parcels of land noted above; and WHEREAS, the applicant and the done all things required to be done application; and Planning Director have in connection with said WHEREAS, the Planning Commission has made a recommendation regarding the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: (1) That the use for which the use permit hereinafter-described ls sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; injurious and (b) Will not be detrimental to the public use or to the property or improvements of the neighborhood; (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. (2) Earl J. Cook, Sr. is hereby granted a use permit pursuant to ~40-69 (b) of the Code of the City of Portsmouth, Virginia to operate a junkyard at the two parcels more particularly described below, such parcels containing approximately .96 acres:
